Terms of Service

1. Service Description

BuiltMonthly provides website design, development, hosting, and ongoing maintenance as a monthly subscription service. Our AI-powered agent teams build and manage professional websites for small businesses and e-commerce brands. All work is performed under the BuiltMonthly brand, powered by Affixed AI.

2. Subscription Plans & Pricing

We offer four subscription tiers:

Additional edits beyond your plan allowance are billed at $25 each. A 20% discount applies when you prepay all 6 months of your initial term upfront.

3. Contract Term & Cancellation

• Minimum commitment: All subscriptions require a 6-month minimum term.
• After initial term: Subscription continues month-to-month. Either party may cancel with 30 days written notice, no early-exit penalty.
• Early exit during contract: If you cancel before completing the 6-month term, the remaining months are billed at 50% of the monthly rate.

4. Domain Ownership

BuiltMonthly purchases your domain in your name as part of setup (included at no additional charge). You own your domain fully at all times. Upon cancellation, your domain is transferred to you at no cost.

If you bring your own existing domain, a one-time $75 domain configuration fee applies.

5. Content & Intellectual Property

• Your content: All text, images, logos, and business information you provide remain your property at all times.
• Website design and code: The website design, templates, and underlying code are retained by BuiltMonthly during the subscription. A $500 export fee grants you full ownership of the website files and codebase upon cancellation.

6. Billing & Payment

All billing is processed automatically via Stripe on your monthly billing date. If a payment fails, you have a 5-day grace period to update your payment method. After 5 days, your site may enter maintenance mode. After 30 days of non-payment, your website may be taken offline. BuiltMonthly is not liable for business losses resulting from service interruption due to non-payment.

7. Limitation of Liability

BuiltMonthly's total liability for any claims shall not exceed the total fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or revenue.

8. Peptide & Supplement Addendum

For clients in the peptide, supplement, or health product industries:

• BuiltMonthly provides website development services only - not regulatory, legal, or medical advice.
• You are solely responsible for ensuring all product claims and marketing copy comply with applicable laws and regulations (FDA, FTC, and state regulations).
• You agree to indemnify and hold harmless BuiltMonthly from any claims arising from your products or marketing claims.
• Attorney-approved copy is required before publication of any health or medical claims. BuiltMonthly reserves the right to refuse or remove content that poses legal or regulatory risk.

9. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
